Archdiocese Fights Back Against Creditors’ Reorganization Plan


It appears that the Archdiocese of St. Paul and Minneapolis is prepared to fight the latest proposal for reorganization that has been put forth by its creditors. Church leaders claim that the most recent proposal falls far short of a fair settlement and is a blatant attack on the church and a clear effort to dismantle the organization. Representatives for the diocese came out strongly against the plan and reiterated their own offer of $155 million while admonishing the victim abuse groups for seeking a larger amount.

The church claims that it simply cannot afford to pay more than $155 million and being forced to go beyond that number is unlawful. Their proposed settlement amount would keep all of the church’s facilities operational and avoid having to lay off employees or face difficulties meeting basic payroll requirements. They are adamant about the fact that a settlement beyond $155 million is not only not feasible, but also illegal according to bankruptcy laws and standards.


According to the Archdiocese, the church would have to include all of their cash, real estate and religious relics in their list of assets. This would put several area Catholic high schools at risk for closure and the church argues that it would be unfair to have the scandal affect their current operations and lead to the elimination of educational and spiritual services that are currently a part of their community involvement.

Despite these arguments, the victims’ group is holding steadfast to their belief that the church should be offering significantly more compensation to victims who were part of a widespread pattern of abuse and ongoing cover-ups by the church. Ultimately, rejecting the church’s offer could lead to further mediation that leaves victims with even less money than the initial offer, but it appears that this is a risk they are willing to take and that they believe strongly in their case and the responsibility of the church to rectify the situation. 


While it is clear that the Archdiocese is prepared for a fight, it remains to be seen whether they will get their way or be forced to reach a compromise with victims that would include a higher compensation package. Moving forward, both sides are likely to continue to file objections and speak out against proposals, but it is up to the judge to rule on the validity, practicality and legality of all potential plans.
