The Bankrupt Archdiocese Objects to Reorganization Plan

The Archdiocese of St. Paul  and Minneapolis is working to settle on a reorganization plan with creditors that would end the bankruptcy process and allow the church to return to some state of normalcy. Despite ongoing negotiations, the diocese has filed several objections to the latest plan from the creditors and once again asked them to accept an offer of $156 million. A judge will make the final decision, but the church is making every effort to prevent creditors from seizing assets.

The church claims that the plan does nothing to reorganize the diocese in a workable way and is actually a clear effort to dismantle the church and prevent it from being able to operate at full capacity. Essentially, it all comes down to what is considered reasonable assets. The creditors are looking at all the cash holding along with the value of real estate locations and religious relics. They see these valuable assets that should be leveraged to provide victims with a larger settlement pot.

Meanwhile, the church continues to provide vastly different asset statements while asking victims to accept an earlier offer of $156 million. When that amount was first proposed, a full 94% of abuse victims voted to reject the Archdiocese’s plan and push forward their own proposal, which they see as a more fair carriage of justice. While the amount of money is the biggest point of contention, the settlement also includes non-monetary environments that would mean the church has to take specifically outlined steps to apologize, make the public aware of their misdeeds and continue to acknowledge responsibility.

Some participants from both sides see further litigation as something worth avoiding. Each passing day only means more legal costs and there is no guarantee that either side will get the number they are looking for when it comes to the final settlement. Agreeing on an amount now could prevent the entire process from continuing to drag on.  Moving forward, Judge Kressel will be taking a closer look at current reorganization plans and sharing his thoughts will all the parties involved. He will have the final say on which plan moves forward and put under further scrutiny for financial and legal viability. At the moment, it is unclear whether the current settlement and bankruptcy process will be coming to a close any time soon.
