What is the Punishment for Catholic Priests Accused of Sexual Abuse?

While the complete scope of the sexual abuse problem within the Catholic church continues to come into focus, many are also asking questions about how exactly priests are being punished or held accountable for their actions. Unfortunately, the answer isn’t quite clear. Over the decades since Reverend Gilbert Gauthe was one of the first priests sentenced to 20 years for his crimes that began in the 1970s, the response from the both the church and civil authorities has been mixed.

Ultimately, the Church’s canon law does allow for priests to be prosecuted, many offenders have been able to effectively avoid jail time. Much of the problem can be attributed to the fact that instances of sexual abuse were covered up by church elders and priests were simply shuffled around to different locations as problems arose. This extensive cover up meant that many priests weren’t exposed until decades later when statutes of limitations had already passed.

The majority of cases have been handled through lawsuits. By 2002, experts estimated that the church had paid one billion dollars in settlements and legal fees to hundred or litigants. Special Grand Juries have also created reports in several cases that found entire diocese incapable of handling instances of sexual abuse, but these findings didn’t come with any real consequences.

It wasn’t until the 2000s that the church actually began to defrock priests and remove them from the church. Since then, the calls for prosecution have gained momentum and civil lawyers have been working hard to find ways to overcome statute of limitations that obstruct priests from being sent to jail.

In July of 2018, Archbishop Adelaide Philip Wilson was found guilty of covering up sexual abuse in Newcastle Australia. He is the highest ranking official to be convicted so far, but due to his health, he will serve just six months in jail. Perhaps even more surprising is the fact that he has yet to resign from the Holy See and is still considered a member of the church.

As 2018 comes to a close, the Vatican continues to be plagued with questions about who knew what and when. At the moment, it appears that Pope Francis is more prepared than any leader before him to hand down strict punishments and restore faith in the Catholic church. However, it remains to be seen whether the church is now capable to handling these issues as priests continue to avoid civil penalties and jail time.
