Now that sexual abuse in the church is an open topic for discussion, lots of people are chiming in with their opinions, and for good reason. One question that many people have is what is an appropriate punishment. Very rarely are the priests defrocked. Often times they are merely shuffled to another jurisdiction. Very rarely are priests criminally prosecuted. How can the authorities prosecute when they don’t have any of the facts. Any good investigator will tell you that you have to collect evidence while it is fresh. People’s recollection of events and memories fade over time. If you don’t interview someone right away, the accuracy of their statement is not going to be reliable. What about civil punishments.

When someone sexually assaults you, you have the right to sue them in civil court right? Well the answer is a little tricky. In theory you have the right to sue them. But in reality, your lawsuit will often times be dismissed because it wasn’t filed in time (the statute of limitations ran out). Many people are talking about changing these laws. If the church knows that abuse is occurring, make it mandatory that they report the abuse to their authorities immediately so that full investigation can be launched and evidence collected. If a priest is tried by a jury of his peers and found guilty beyond a reasonable doubt, then jail time is likely going to be involved in the sentencing. And for good reason. The public policy should supportive of such measures. Not only will this serve justice, it will also serve as a deterrent. Moreover, it will stop that specific criminal from assaulting other kids.

Civil justice reform is also needed. If Church’s are successfully sued for large amounts of money and forced to pay the judgements (and not hide behind the bankruptcy courts) then you can bet your bottom dollar they will respond appropriately and take measures to prevent priests from abuse kids. Of course these solutions are just the tip of the iceberg. We need cultural seismic change in the Church. If some of these measures were implemented, then more victims would probably feel comfortable coming forward.
