A Federal Judge Weighs Legality of Reorganization Plans for the Bankrupt Archdiocese of St. Paul and Minneapolis
 
Judge Robert Kressel, who has been tasked with overseeing reorganization plans for the bankrupt Archdiocese of St. Paul and Minneapolis, now has to decide whether two proposed plans meet legal muster. While each side is pushing for their own plan and filing objections, it is up to the judge to rule on whether either plan meets legal standards. From there, he can make a final ruling, but at this point, it appears that he has some initial misgivings about the validity of both plans.

The church is continuing to push a plan that offers victims $155 million. They claim that this amount is the absolute most they can afford to contribute to the settlement without undermining their operations and putting themselves in a position where it is difficult to pay employees. However, abuse victims and their attorneys are claiming that the church is not accurately reporting all of their assets and that they could quite easily offer more money.
 
The problem is that by returning to mediation, the victims groups risk being offered and having to settle for a number lower than the initial $155 million that the church is holding tight to. The entire process is a bit of a gamble and Judge Kressel has expressed concerns that the victims might be motivated by unrealistic expectations. If this process continues as it has been, the victims might still have to wait years for a resolution. Already, several of the 400+ victims named in the suit have passed away and adding years to the litigation could mean that more people pass away before receiving their funds.

As it stands now, both plans will be examined in more detail by the judge in order to determine whether they meet legal standards. Judge Kressel has not set a date for when he will rule, so families are back to waiting and hoping that they can get more money from the church. The Judge has also ordered victims attorneys to stop submitting invoices for their services. At the moment, legal fees are expected to land at around $20 million, which would be deducted from the total settlement.
 
Hopefully, this period in the Archdiocese’s history will soon come to a close and both priests and victims will be able to move forward and try to reconcile in some way.
