Following its filing of bankruptcy in 2015 as a result of the Minnesota Legislature opening a three-year window in the statute of limitations for filing for a sexual abuse civil lawsuit, the Archdiocese of St. Paul and Minneapolis reached a settlement agreement with 450 victims of clergy sexual abuse in May 2018.  The agreement was for a total of $210,290,724, and it would be divided among the victims in an undetermined way.  A formal reorganization plan would be sent to a bankruptcy judge and, if approved, to the victims for a vote.  Attorneys for the victims felt confident it would be approved.

The settlement is the second largest in the United States after the Archdiocese of Los Angeles settled with victims for $660 million in 2007.  Of the at least 15 dioceses that had filed for bankruptcy protection, this was the largest payout.  The case slowly proceeded as attorneys for the archdiocese and the victims debated over how much the archdiocese should pay.  Attorneys for the victims wanted the archdioceses’ assets to include the 187 parishes as well as all other church entities, like schools and cemeteries, in the determination of the settlement amount.

Most of the settlement was to be funded by insurance carriers for the archdiocese.  About $170 million of the total would come from insurers, and the remaining $40 million would come from the archdiocese, individual parishes, a pension fund, and sales of church real estate.  Thomas Abood, the chairman of the Archdiocesan Finance Council and Reorganization Task Force, promised that the archdiocese would expedite the payment.  He claimed that they had raised money for the settlement and expected to have the process completed in just a few months.

The settlement was approximately $50 million more than the archdiocese’s initially proposed settlement amount, and experts said this points to the value of the negotiations giving the victims a voice in the outcome.   Victims would be empowered to not just accept initial offers and to fight for more.  Archbishop Bernard Hebda expressed gratitude to the victims involved in the lawsuit and apologized for the archdiocese’s role in covering up for the abusive priests.  He recognized that the victims had their childhood, innocence, safety, and ability to trust taken from them, and he expressed hopes that the settlement would bring them closure.
