After years of negotiations, the Diocese of San Diego agreed to pay $198.1 million to the sexual abuse victims of its priests.  This was the second largest settlement against a diocese in the United States.  The 144 victims who were the plaintiffs in the case each received an average of $1.38 million, which gave each victim an average of $825,000 after legal fees.  The diocese had previously offered to settle the cases for $95 million, but that offer was not accepted.

Victims were relieved by the settlement, but many expressed anger at the church for unnecessarily prolonging the settlement negotiations.  There were also lingering accusations that the church leadership had deliberately hidden the accusations against abusive priests.
The diocese filed for bankruptcy protection months before the settlement was reached using the argument that it was the best way to ensure compensation for the victims, but the bankruptcy case was dismissed after seven months.

The diocese was responsible to pay $107 million of the total settlement with $76 million coming from their insurance carrier and almost $15 million coming from the Diocese of San Bernardino, a former part of the Diocese of San Diego.  The San Diego diocese paid $40 million from sales of real estate.

The diocese asked its parishioners to donate money in the amount of $25 million to help pay the settlement.  Bishop Robert H. Brom requested the donations in a letter to parishioners in October of 2007 warning them that the diocese might have to sell its headquarters and a seminary if they were unable to raise enough money in donations.  Bishop Brom had previously asked each of the priests in the diocese to donate one month’s salary in a campaign of goodwill to the 144 plaintiffs involved in the sexual abuse settlement.

The Diocese of San Diego refused to release the personnel records of the 48 priests involved in the case.  The diocese fought the release in court until October 2010 when a San Diego County Superior Court judge ordered the release of thousands of pages of documents.

Bishop Robert McElroy assumed leadership of the Diocese of San Diego in 2015, and he authorized reforms to protect children in the diocese’s parishes.  Every employee must undergo a background check, and parents and children are taught the warning signs of abusive priests and how to recognize behavior that is inappropriate.  Hopefully this trend will continue across the country and protect kids.
