The Bankrupt Archdiocese of St. Paul and Minneapolis is Ordered Back to Mediation with Creditors
In late 2017, a federal judge rejected plans for reorganizing the Archdiocese of St. Paul and Minneapolis after it declared bankruptcy. Two proposed plans were turned down after the judge decided that they were plagued with too many shortcomings. Not only did neither plan provide enough compensation for victims, they also focused too much on unreliable sources for raising the necessary funds. Victims and their attorneys agreed wholeheartedly with the decision and were more than happy to return to the mediation table and try to recover more compensation.

Early on in the mediation process, the church claimed that creditors were engaging in “an unlawful dismantling of the Catholic Church in the Twin Cities.” The flood of lawsuits were the result of lawmaker’s efforts to bring justice to victims and their families as the scope of the scandal continued to spread. In 2013, the Minnesota Legislature provided a three-year period where victims could sue for damages and in just two years the Archdiocese had to file for bankruptcy. While the Church recognized the need for some type of settlement, they were not prepared to sacrifice what they viewed as the foundation of the Archdiocese.

Mediation has been slow going in part because there has been some dispute about exactly how much money the Archdiocese had when hundreds of claims of sexual abuse against priests were first filed. The organization claimed a net worth of just $45 million, but some attorneys claim that the diocese is actually valued at $1 billion. The Church also fought hard to protect certain assets that victims’ attorneys thought should be fair game when it came to raising money to pay the settlement.

Ultimately, schools, cemeteries and other church facilities were included along with other assets that covered 187 parishes. In June of 2018, the Archdiocese of St. Paul and Minneapolis reached a settlement of $210 million for 450 victims. It is the second largest settlement in the history of the Catholic sex abuse scandal. This money will be split among victims and used to pay for mental healthcare and other expenses.

Ultimately, the victims appear to be okay with the amount of money and see the mediation as just another chance to show that their voices will be heard despite the power and reach of the Church. While the money can’t heal all wounds, it does serve as a symbolic victory that will allow some abuse victims to move forward with their lives.
