One of the hardest things to do for a victim of sexual abuse is to admit that it happened in the first place.  Many victims live with a cloak of secrecy their whole lives.  Instead of reaching out and getting the necessary help they need to rehabilitate themselves and ease their pain, many victims suffer silently.  Many ask themselves, what’s the point of coming forward?  Nothing is going to come of it.  The time limits on a case have already expired.  The priest won’t go to jail or be held accountable.  These are reasonable objections, no doubt about it.

A clergy member who molested a child cannot always be prosecuted, due to overly limited statutes of limitations in many states. And victims cannot always successfully sue in civil court either.  It doesn’t have to be that way.  If enough people stand up and contact their elected representative, change can occur.  Change needs to occur to the time limits that people have to bring a case.  The fancy word for this is statute of limitations.  Put simply, once a victim is sexually abused, the clock starts ticking against them.  They have a limited time to hire a lawyer and start a case.  They also have a limited time to go to the authorities and try to have the priest prosecuted.  Why in the world are there any time limits on such cases?

A case that occurred in 2014 illustrates the dynamic at play here. In that year, a law firm released documents revealing that James Jansen, a priest who had already been defrocked, was revealed to have molested an altar boy in Joliet Diocese in 1956. The Davenport diocese has reported that he has been accused of abuse by a total of 36 former victims, with the incidents having begun in the early 1950s. (Another accounting places the number of accusers at over 40.)

Take the case of the infamous priest, James Jansen.  Accusations against him went as far back as the 1950s where he was accused of molesting young boys at the YMCA.  It wasn’t until 1958 that he confessed his guilt.  Did he go to jail for his crimes?  Of course not.  He was only suspended, for less than one year.  He would remain a priest until 1991 when he retired.

The Quad-City Times wrote a report about Jansen and asked him for a comment.  “Janssen stated that he was dying of cancer and declined to offer any statement or apology to the victims.” Janssen was finally defrocked in 2004 and has been subject to many lawsuits.
