The Old Problems and Controversies of the New York Child Victims Act
Now that the Child Victims Act has been signed by Governor Cuomo, it is important for us to explore the history of this legislation and remind ourselves who fought against it. For more than a decade, many fought to have a form of the Child Victims Act approved into New York law and met serious opposition. Who would be opposed to helping victims that were sexually molested you ask? Good question. In June of 2017, the Child Victims Act of New York was wiped out in the Senate to the dismay of the public, advocacy communities, and a lot of government reps.
There were numerous challenges and controversies around this legislation that prevented it from turning into law for so long, despite the fact that related bills were passed in other states. Come on New York, be a leader.

Let’s not forget that the Roman Catholic Church, proclaiming that the legislation unfairly targeted them while offering protection to abusers inside the public school system.
Cardinal Dolan mentioned that this particular bill was unjust to Catholics, and believed that the settlements that will take place as a consequence of the bill passing would effectively bankrupt the Church and prevent them from performing their charitable work. Just think about the logic of that statement for a moment. For purposes of illustration, imagine that you broke the law and someone sued you to hold you accountable. Is it a legitimate defense to say that if you are held accountable and are forced to pay your victim, you will go bankrupt and not be able to perform your regular work? Of course not. People would laugh you out of the building for making such a preposterous claim. Yet this is the argument the Church put forward. Bottom line, the churches that didn’t allow abuse will be just fine. The churches that covered it up must be held accountable just like anyone else would be under similar circumstances.

Oh and let’s not forget about the venerable Boy Scouts of America. They also took legal action in opposition to the passing of the Child Victims Act, and hired a former senator to lobby against the bill. People of good conscious really have a problem with this. Why would any organization try to prevent a victim of sexual abuse from having their day in court? Let the chips fall where they may. If the alleged perpetrator is innocent, it will come out in court. If the jury finds them guilty, then hold them accountable. This is a core principle of American jurisprudence.
