After the stinging defeat of the Child Victims Act in 2017, many people lost hope. As many of you will remember, the legislation was killed in the senate after intense lobbying from the Catholic Church and Boyscouts. Fortunately, the country and New York specifically are getting wise. Governor Cuomo recently signed the Child Victims Act, which should do a lot in terms of holding criminal molesters accountable. Equally important, those wrongfully accused will have their day in court and be cleared of the charges. It’s a win win, unless you have something to hide? The Catholic Church tried to hide behind the flimsy argument that if this law was signed into the books, then the floodgates would open and the church would be sued into bankruptcy?

Is that really a reasonable argument to make? Many people are aware of all the good works the Catholic Church does. However, if there was criminal behavior that was covered up that needs to be exposed, and the victims need to be compensated for that. Why two sets of rules. What’s good for you is not good for me. Surely everyone agrees that if they broke the law and harmed someone, they should be held accountable and not be able to hide behind some archaic law that says the clock ran out on your victims ability to sue. Yet this is the argument that is being made across the country. The good news is that there is a profound cultural shift taking place across America. Each state is now wrestling with these issues, and many have led the way in changing their statute of limitations.
Other states have empaneled grand juries and begun the painstaking task of collecting the facts and evidence. Again, this cannot be stated enough. If the Church has nothing to hide and is innocent of these charges, then nothing bad will result and many of these priests who have been accused will have their good names cleared. However, if many of these priests are in fact guilty of abusing small children, then who in their right mind is interested in seeing them skate free while the victims continue to suffer? For those of you that don’t know, the new legislation does several things.

Allows victims to file a civil lawsuit at any time before they reach 55 years of age, and provides victims whose claims were already time barred a new opportunity to get their day in court by opening a one year window to commence legal action.
Increases the amount of time during which perpetrators of these crimes may be held criminally accountable
Eliminates the need to file a notice of claim for sexual offenses committed against a minor;
Requires judicial training with respect to crimes involving the sexual abuse of minors;
Authorizes the Office of Court Administration to promulgate rules and regulations for the timely adjudication of revived actions.
