FAILURE TO REPORT ALLEGED CRIMINAL ACTS TO POLICE


One of the most glaring revelations from the Pennsylvania grand jury report of 2018 was the extent bishops in the six investigated dioceses went to in efforts to shield abusive priests from repercussions.  The report found that there were 301 priests and church employees with sound allegations against them.  Bishops in the dioceses were found to have reassigned the offending priests instead of reporting them to law enforcement.
According to the report, bishops enabled the abusive priests by placing them in ministry in a new location after an allegation of abuse and encouraged victims not to report the abuse to law enforcement.

Bishops also were found to have exerted their influence to convince police to end investigations or to not investigate at all.  Bishops sometimes, instead, held their own investigations that still led to no reporting of crimes to the police.  The report found that the church acted to protect the institution first rather than the victims.


Pennsylvania Attorney General Josh Shapiro, the leader of the state’s investigation into the Catholic Church’s institutional cover up of sexual abuse, stated that the church participated in the shielding of abusive priests in an effort to exhaust the statute of limitations on allegations.  The longer the abuse was covered up, the less likely any charges could be brought against predatory priests.  Shapiro also accused the Vatican of having complicity in the abuse cover up.

In Pennsylvania, the statute of limitations in sexual abuse cases prevents criminal charges from being filed after the victim reaches the age of 50.  For civil lawsuits, victims can only file until they reach the age of 30.  Following the grand jury report and recommendation, the Pennsylvania state legislature introduced a bill that would eliminate the statute of limitations for prosecution and raise the limit for civil cases to the age of 50. 


Due to a precedent set by the United States Supreme Court, even if the law were changed, any victims now past the age of 50 would still be unable to pursue criminal charges against their abusers.  Pennsylvania State Representative Mark Rozzi, himself a childhood victim of sexual abuse, pushed for an amendment to the bill to allow a two year window during which any victim of any age would be able to pursue a civil lawsuit, an act that was also recommended by the grand jury in its report.
