Twin Cities Archdiocese Case is Finally Over


In January of 2015, the Archdiocese of St. Paul and Minneapolis filed for chapter 11 after being sued by 450 sexual abuse victims. Claiming bankruptcy provides the church with certain protections that allow them to develop a plan for paying settlements and hopefully reaching some sort of reconciliation with victims. It also removes the potential for any future cases and liabilities associated with past incidents. The process is difficult for all parties involved and this case has been especially trying.

While the road to a settlement has been long and contentious, it appears that a resolution has finally been reached after almost four years of bankruptcy. On September 25th, Judge Robert Kressel approved a plan that was a full $50 million more than the original offer. Victims are happy with the results and all parties involved are ready to move forward.
The litigation process was dragged out as the church tried to avoid having to sell off properties. Ultimately, most of the money, around $185 million, will be covered by 25 insurance carriers that are also wrapped up in the case. A full $21 million was raised after selling three Catholic high schools in the area and the final $4 million will be extracted from a archdiocese related healthcare fund.

There was also some controversy about how much the archdiocese is actually worth. The church tried to downplay its assets, but victim’s attorneys estimated that the actual value was around $1.7 billion. This enormous gap only delayed proceedings as each side wrote up exit strategies based on their own valuations and both proposals were promptly rejected by Judge Kressel. Both sides were forced to return to the negotiating table and try to come up with a new deal.

The $210 million settlement also includes provisions that require the church to take concrete steps to protecting children and preventing further abuses. Other similar settlements have stipulated that the names of all clergy and lay leaders who were either perpetrators or involved in the cover up. There have also been instances where dioceses are required to offer a personal apology to each victim, place plaques in parish schools and regularly publish victims’ stories in church publications. Now that the case is finally over, it is these non-monetary measures that will continue to make an impact on the church and the community.
